MBTItype.com Terms of Use

By registering or creating an MBTItype.com account (“Account”), or by accessing or otherwise using the MBTItype.com website (“Site”), you agree to be bound by these MBTItype.com Terms of Use (“Terms of Use”) as of the moment you create your Account. You must be at least sixteen (16) years old to use the Site; if you are under sixteen (16) years old, please do not create an Account.
1. The Site
The Site is provided by The Myers-Briggs Company, a California benefit corporation (the Company). Upon registering your Account, you will be able to view the content and information made available on the Site. To register your Account, please follow the instructions on the Site and provide the necessary information. In order to register, you will need to provide the access code (“Access Code”) that was included in your Introduction to Type or similar booklet. Access Codes are one-time use only. You may not share your Access Code with any other person. Each Account may only be used by a single user. The Company reserves the right to terminate or suspend your Account if the Company discovers you have shared your Access Code or account credentials in violation of these Terms. Subject to these Terms of Use, the Company shall grant you access to the Site after you have successfully registered your Account.
The Site may be unavailable during planned downtime or as a result of circumstances beyond the Company's control, including (without limitation): acts of God; acts of government; flood; fire; earthquakes; civil unrest; acts of terror; strikes or other labor problems; equipment malfunctions; power failures; and/or Internet service provider failures. You have no expectation regarding the availability of the Site. The Company may alter or modify the Site at any time for any reason without penalty without providing notice to you. The Company may choose to make the Site unavailable temporarily or permanently or replace the Site with a successor or replacement Site at any time for any reason without penalty and without providing notice to you.
2. Data
In order to use the Site, you must provide certain limited personal information to create and register your Account. The Company will use personal information you provide in accordance with the Company's Privacy Policy. The Company may store data relating to your Account for you for as long as your Account remains active. If your Account becomes inactive for eighteen (18) months, then the Company will delete or anonymize your Account and you will lose all access to your data. The Company reserves the right to delete your data at any time without notice to you if you are in breach of these Terms of Use. At all times, both while your account remains active and thereafter, the Company reserves the right to retain all data generated via the Site in non-personally identifiable format for the Company research, product development, and other business purposes.
Your use of the Site requires the transmission of your personal information to the Company in the United States of America. If you are using the Site outside of the United States of America, then by registering an Account and agreeing to these Terms of Use, you acknowledge and agree to such transfer of your personal information. As between you and the Company, the Company is the data controller for all personal information processed via the Site.
3. Your Responsibilities
You shall not sell, resell, rent, or lease your access to the Site. You shall not use the Site to store or transmit any infringing, libelous, or otherwise unlawful material, or to store or transmit material in violation of third-party privacy or intellectual property rights. You shall not use the Site to store or transmit malicious code or software that will impair the functionality of the Site or otherwise access the Site in a manner not consistent with the lawful purpose of the Site. You may not copy, frame, or mirror any part of the Site or reverse-engineer any part of the Site. You may not access the Site in order to build a competitive product or service or to copy any features, functions, or content from the Site. You may not remove any copyright, patent, trademark, or other proprietary notices from products offered on the Site.
4. Intellectual Property
Your use of the Site involves the Company's intellectual property, and use of that intellectual property is governed by these Terms of Use. You agree that the Company is the sole and exclusive owner of the Site and the products and other works that are offered on the Site (collectively, the “Company Content”). The Company reserves all rights, title, and interest in and to the Company Content, including all intellectual property rights. No transfer of rights is intended by these Terms.
5. Term & Termination
These Terms of Use will govern your access to and use of the Site beginning as of the moment you register your Account and will continue in effect until your account is deleted, either at your request or by the Company's action as set forth in these Terms of Use. You may choose to delete your account by contacting support.us@themyersbriggs.com. If you request that the Company delete your Account, you will lose all access to your data. If your account is deleted for any reason, you will not receive any refunds, credits, or any other form of value.
6. Limitation of Liability
IN NO EVENT SHALL THE COMPANY'S LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OF USE, WHETHER IN CONTRACT, TORT, OR UNDER ANY THEORY OF LIABILITY, EXCEED IN THE AGGREGATE THE TOTAL AMOUNT PAID BY YOU UNDER THESE TERMS OF USE. IN NO EVENT SHALL THE COMPANY HAVE ANY LIABILITY TO YOU FOR ANY LOST PROFITS OR REVENUES OR FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, OR UNDER ANY THEORY OF LIABILITY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Miscellaneous
You agree to defend and indemnify The Company, its officers, directors, employees, and assigns against any claims, damages, losses, costs, or liabilities of any kind (including reasonable attorneys’ fees) arising out of or in connection with any actual or alleged breach of these Terms of Use, or in connection with any third-party suits or claims alleging matters which, if true, would constitute a breach of these Terms of Use.
THE SITE AND ITS ASSOCIATED FUNCTIONALITY ARE PROVIDED “AS-IS.” THE COMPANY MAKES NO REPRESENTATION OR WARRANTY REGARDING THE SITE OR ITS FUNCTIONALITY, INCLUDING ANY REPRESENTATION THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, THE COMPANY DISCLAIMS ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE
These Terms of Use do not create a partnership, franchise, joint venture, fiduciary, or employment relationship between you and the Company; we are independent contractors. Except as otherwise specified in these Terms of Use, all notices, permissions, and approvals under shall be in writing. Notices to the Company shall be addressed using the information made available under the “Contact Us” portion of the site. All notices to you shall be addressed to the most recent contact information associated with your Account. No failure or delay by the Company in exercising any right under these Terms of Use shall constitute a waiver of that right. Other than as expressly stated herein, the Company's remedies provided herein are in addition to, and not exclusive of, any other remedies at law or in equity. If any provision of these Terms of Use is held by a court of competent jurisdiction to be contrary to law, that provision shall be severed from these Terms of Use, and the remaining provisions of these Terms of use shall remain in effect. You may not assign any of your rights or obligations under these Terms of Use, whether by operation of law or otherwise, without the prior written consent of the Company. These Terms of Use, and any disputes arising out of or related to these Terms of Use, shall be governed exclusively by the internal laws of the State of California, without regard to its conflicts of laws rules or the United Nations Convention on the International Sale of Goods. These Terms of Use constitute the entire agreement between the parties and supersede all prior and contemporaneous agreements, proposals or representations, written or oral, concerning their subject matter. Any provisions of these Terms of Use that by their nature would survive shall survive any termination or expiration of these Terms of Use or termination or expiration of your Account. The Company may modify these Terms of Use at any time for any reason with or without notice to you.
8. Cookies Statement
A cookie is a small text file that a website sends to a visitor’s browser and that sends back information each time the visitor makes a request from the website. A cookie contains a unique identification number that identifies the visitor’s browser, but not necessarily the visitor.
